1. Introduction:
PES is committed to providing comprehensive and environmentally responsible waste management solutions, specializing in the collection and destruction of both non-hazardous and hazardous chemical waste originating primarily from the Permian Basin. This policy outlines the types of waste accepted for processing using our licensed technology, ensuring compliance with all applicable federal and state regulations.
2. Accepted Waste Streams:
PES accepts a wide range of waste materials, including petroleum-based products, oil well-derived products, and related materials in solid, liquid, and gel forms. Specifically, we accept:

3. Waste Acceptance Criteria

All waste materials must be accurately characterized and accompanied by appropriate documentation, including waste analysis reports and manifests as required by regulatory agencies.

Waste materials must be free from prohibited items, such as radioactive materials, explosives, and other materials that pose an immediate and significant safety risk.

Acceptance of specific waste streams is subject to our facility's capacity and regulatory permits.

We reserve the right to refuse any waste that we deem to be outside of our permit allowances, or that presents an unmanageable risk to our employees or the environment.

The Permian Basin, for the purposes of this policy, includes the counties of Texas and New Mexico.
10. Waste Acceptance and Inspection Procedures
"All incoming waste shipments are subject to thorough inspection and evaluation upon arrival at PES's facility. This process includes, but is not limited to:

Visual Inspection: A visual examination of waste for any signs of non-compliance with the provided documentation or this policy.

Documentation Verification: Verification of all accompanying documentation, including waste analysis reports, manifests, and any other required paperwork, to ensure accuracy and completeness.

Sampling and Testing (if necessary): In cases where the waste's composition is uncertain or requires verification, representative samples will be collected and subjected to laboratory analysis.
Load Rejection Criteria:
Shipments will be rejected and returned to the customer at their expense under the following conditions:

Undocumented materials: Any waste received without the required documentation or with incomplete or inaccurate documentation.

Non-conforming waste: Waste that does not meet the acceptance criteria outlined in this policy or that exceeds regulatory limits for specific contaminants.

Prohibited materials: Any waste containing materials that are prohibited by this policy or by applicable regulations.

Discrepancies: Significant discrepancies between the documentation provided and the actual contents of the shipment.

Contamination: any contamination that would create a hazard for our employees or equipment.
Customer Responsibility:

The customer is responsible for accurately characterizing and documenting their waste.

Any costs associated with the rejection and return of a shipment, including transportation and handling, will be the customers’ responsibility.

Customers are responsible for properly containing and labeling their waste in accordance with all applicable regulations.
11. Policy Updates:
This Waste Acceptance Policy will be reviewed and updated periodically to reflect changes in regulations, technology, and industry’s best practices.
